New Regulations on Opening Offshore Foreign Currency Accounts from Dec 15, 2025

From December 15, 2025, Circular 39/2025/TT-NHNN of the State Bank of Vietnam takes effect, detailing cases where organizations that are residents are permitted to open and use foreign currency accounts abroad.

Permitted cases include:

  • Credit Institution Group: Permitted to open foreign currency accounts abroad to perform foreign exchange operations, fulfill obligations related to foreign loans, meet conditions for establishing representative offices/branches/banks abroad, or serve the regular operations of representative offices abroad.
  • Economic Organization Group: Must be granted a License by the State Bank. Cases include: meeting conditions to establish branches/representative offices abroad, serving the regular operations of these units; fulfilling obligations related to foreign loans; participating in particularly important investment projects or Public-Private Partnership (PPP) projects; or fulfilling commitments/agreements/contracts with foreign parties (e.g., construction contracts, ship purchase contracts).
  • Other Organizations Group: Permitted to open foreign currency accounts abroad to receive aid/sponsorship from abroad or other cases permitted by competent Vietnamese authorities.

The usage duration of the License to open foreign currency accounts abroad is regulated flexibly depending on the purpose and duration of relevant legal documents (e.g., documents allowing temporary establishment, validity period of establishment documents, deadline for completing debt repayment obligations, contract/agreement duration).
